Terms of Service

White Pine Labs ("we", "us") is a Canadian software studio that builds software products, including Daily Tasks. These terms govern your use of this website and our products. By creating an account or otherwise using our products, you agree to these terms. If you do not agree, please do not use our products.

Eligibility and accounts

You must be at least 18 years old to create an account. Daily Tasks accounts are held by a guardian on behalf of someone they support, who may be a minor or an adult who cannot independently agree to these terms; the dependent does not create their own account. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account.

Guardians and dependents

By entering information about a dependent, you confirm that you have the authority to do so on their behalf and that you accept these terms and our Privacy Policy on their behalf. You are responsible for deciding what information about a dependent is appropriate to enter into the app.

Subscriptions and billing

Some features of Daily Tasks are offered on a paid subscription basis. If you purchase a subscription:

• You authorize us (or the applicable app store, such as Apple or Google, if that is how you purchased) to charge the then-current fee on a recurring basis until you cancel.
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• You can cancel at any time; cancellation takes effect at the end of the current billing period, and you will keep access to paid features until then.
• Fees are generally non-refundable, except where required by law or by the refund policy of the app store you purchased through.
• We may change subscription pricing on a going-forward basis. We will give you reasonable notice before a price change takes effect for your account.

Using our products

You may use our products only for their intended, lawful purpose. You agree not to misuse our products, including by attempting to gain unauthorized access to any account or system, interfering with normal operation, reverse engineering the app beyond what is permitted by law, or using the service to store or transmit unlawful content.

Intellectual property

White Pine Labs owns all rights, title, and interest in our products, including the app, website, and associated branding. These terms do not grant you any ownership rights in our products. As between you and us, you retain ownership of the information you enter about yourself or a dependent, and you grant us the limited right to use it solely to provide and support the service, as described in our Privacy Policy.

Availability and changes to the service

We aim to keep our products reliable but do not guarantee uninterrupted or error-free availability. We may update, change, or discontinue features over time, and we will make reasonable efforts to notify you of material changes that affect paid features.

Termination

You may stop using our products and delete your account at any time. We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the product, in which case we will provide notice where reasonably possible. Sections of these terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will continue to apply.

Disclaimer of warranties

Our products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as required by applicable law.

Limitation of liability

To the extent permitted by law, White Pine Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of our products. Our total liability for any claim relating to our products will not exceed the amount you paid us for the service in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold White Pine Labs harmless from any claims, damages, or expenses arising from your misuse of our products, your violation of these terms, or information you provide about yourself or a dependent.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that the courts located in Ontario will have exclusive jurisdiction over any dispute arising from these terms or our products.

Changes to these terms

We may update these terms from time to time. We will update the "last updated" date above and, where changes are material, provide additional notice. Continued use of our products after a change means you accept the updated terms.
